Disclosure Rules for Stories and Disappearing Content
Make sponsor disclosures readable in Stories and ephemeral video, preserve approval evidence, and avoid relying on captions viewers never see.
A sponsored Story should carry a disclosure on the image or video where viewers can notice, read, and understand it during the available time. Do not rely on a profile biography, earlier Story card, or audio alone. Ephemeral content is difficult to monitor after publication, so approve the final cards and preserve evidence before they disappear.
Put disclosure on the content viewers actually see
The FTC's Endorsement Guides Q&A says a disclosure can be superimposed on Snapchat or Instagram Stories. It should be easy to notice and read in the time available, considering competing text, size, contrast, and duration. Audio alone can be missed by viewers watching without sound.
Start with the endorsement card itself. If Card 3 recommends the product, a disclosure only on Card 1 may be gone before someone enters or taps forward. Repeat disclosure on cards that function independently as ads.
Use straightforward wording:
- “Ad for Acme”
- “Acme paid me for this Story”
- “Gifted by Acme” when free product is the only benefit
- “I earn commission from this link” for a compensated link
Do not crowd the statement into a decorative hashtag stack or put it beneath interactive UI.
Test legibility against time, motion, and interface
The FTC's Disclosures 101 says viewers need enough time to notice and read an image disclosure and advises putting video disclosure in the video itself. Review the exported asset on a real phone.
Checklist:
- Disclosure appears before or with the endorsement
- Font remains readable on the smallest expected screen
- Text contrasts with every moving background frame
- Platform controls, captions, stickers, and reply fields do not cover it
- Card duration permits an ordinary viewer to read it
- Video includes visual and, where useful, spoken disclosure
- Each separately viewable sponsored card works alone
There is no universal safe-zone coordinate that proves legal adequacy. Interfaces change by platform, device, placement, and account configuration.

Preapprove because real-time monitoring may be impossible
FTC staff recognizes there may be no practical way to monitor ephemeral endorsements in real time and suggests requiring preapproval of paid posts. That does not mean every Story campaign must use one identical workflow; it means the control should fit the visibility risk.
Collect before launch:
- Final exported cards or screen recordings
- Intended order and duration
- Approved disclosure wording and placement
- Link, code, offer, and expiration details
- Claim substantiation and product restrictions
- Platform paid-content settings
Approval of a storyboard is not approval of a final card if the creator moves text, adds stickers, or changes duration.
Ask the reviewer to time a normal reading rather than merely confirming that text exists in a frame. Pause-and-zoom behavior is not the standard viewing experience. If a person must stop the Story, cover an interface element, or take a screenshot to understand the disclosure, redesign it. A short extra card is often less useful than keeping the disclosure with the exact product message it explains.
Address common ephemeral-content edge cases
A saved Highlight. Once preserved, the content is no longer truly temporary. Confirm the disclosure remains current and visible in the Highlight sequence.
A repost by the brand. Reassess the disclosure in the new placement and confirm usage rights. A Story sticker may not survive download.
One disclosed opening card, several product cards. Viewers can enter later or tap past the opening. Repeat notice where needed.
A silent product tag. A brand tag can itself communicate approval but does not explain a paid or gifted relationship.
Close Friends content. A smaller audience does not automatically remove advertising obligations.
Affiliate swipe or sticker. Put commission disclosure close to the recommendation and link; a personalized code alone may be unclear.
Unscheduled creator post. Give creators a quick approval path and clear preapproved language, then address known errors rather than ignoring them.
Preserve evidence and corrections
Save a timestamped screen recording of the live Story, not only the design file. Record account, publication time, sequence, disclosure, links, reviewer, and any correction. If a disclosure is missed, act promptly, preserve evidence, and determine whether replacement content or other remediation is appropriate with counsel.
Recheck platform UI and official guidance in publication week. Foreign law and regulated-product rules may require different wording, placement, or retention.
